The European Commission has just dropped a big one: Commission Regulation (EU) 2025/877, updating the Cosmetics Regulation (EC) No 1223/2009. Translation? A fresh batch of ingredients has officially been banned from all cosmetic products in the EU — and it’s time to check your labels.
What's the Deal with CMR Substances?
CMR stands for Carcinogenic, Mutagenic or Reprotoxic. Not exactly ingredients you'd want in your moisturiser or pet shampoo, right?
Under Article 15 of the Cosmetics Regulation, these substances are a no-go unless they’ve been very specially exempted — like when safe use has been proven in food products. And if they’re listed in the CLP Regulation (EC No 1272/2008) as CMRs, you can bet they’re under heavy scrutiny.
What's New in Regulation 2025/877?
As of 12 May 2025, a new wave of substances has been officially added to Annex II (the blacklist) — and come 1st September 2025, they’re banned from all cosmetics sold in the EU.
Here are just a few of the newly outlawed names you might spot in legacy formulas:
Trimethylbenzoyl Diphenylphosphine Oxide (CAS 75980-60-8) – a.k.a. the go-to for artificial nails.
Tetrabromobisphenol-A (CAS 79-94-7)
Clothianidin (CAS 210880-92-5)
Dibutyltin Oxide (CAS 818-08-6)
4-Nitrosomorpholine (CAS 59-89-2)
And many more complex chemical reaction masses that chemists love (and regulators are watching closely).
You can view the full list in the official publication, but the takeaway is clear: if it’s on Annex II, it’s off-limits.
Mark Your Calendar: 1 September 2025
This is your key deadline. By then:
Products on the EU market must not contain any of the banned ingredients.
Remaining stock must be withdrawn.
Reformulations should be ready to go live.
And let’s talk about one in particular: Trimethylbenzoyl Diphenylphosphine Oxide. Previously permitted in nail systems under Annex III, it’s now banned entirely. So if you’re using it in nail products — even the coolest chrome sets — it’s time to swap it out.
What Needs Updating?
If you’re a Responsible Person under EU law, your to-do list includes:
Updating your Product Information File (PIF)
Revising the Cosmetic Product Safety Report (CPSR)
Submitting new CPNP notifications
Double-checking your supply chain compliance
Distributors and importers — you’re not off the hook either. If you're shipping or selling within the EU, products need to be squeaky clean (figuratively and literally).
